We Collect, Use, and Process Information
- OurSong is a new type of music social and collaboration platform, and information you upload to the Service may be publicly viewable and searchable by the Service members and non-members.
- We aggregate certain information about our members’ use of the Services for business purposes and we sometimes publish that information or share it with others.
- We give you several ways to control what information is shared with others and the public and are continuously working to enhance privacy options available to you.
OurSong collects, uses, shares, and otherwise processes the information we have about you for the purposes described in this Privacy Policy, including:
- as necessary to provide the Services and fulfill our obligations pursuant to the Terms of Service;
- where you have consented to the processing;
- where necessary to comply with a legal obligation, a court order, or to exercise and defend legal claims;
- to protect your vital interests, or those of others, such as in the case of emergencies;
- where you have made the information public; and
- where necessary for the purposes of OurSong’s or a third party’s legitimate interests, such as our interests in protecting our members, our partners’ interests in collaborating with our members, and our commercial interests in ensuring the sustainability of the Services.
What Information We Collect
Basic personal data for Registration.
When you create an OurSong account, we will collect your personal information , such as your username on the Platform, email, photos and password. To keep your OurSong account secure, we may need to collect your phone number.
Additional personal data for some main features on the Service.
For acquiring/ transfer of a Card we may need to collect additional information, such as date of birth, your location (including country, state and city) and phone number.
For the offloading / exchange of Ourcoin for certain legal currency or fiat money, your government issued ID (or passport), selfie yourself with government ID (or passport), real name and ID number will be required to provide by you and collected by us . This information is necessary to meet our KYC (Know Your Customer) requirements sufficient to properly record contributions on the blockchain.
Information you post. We collect the information you post in a public space on our website or apps, or on a third-party social media site.
Demographic information. We may ask you for additional information about you or events you like or products you buy, for example as part of a survey or contest.
Other information. If you use our website or apps, we may collect information about the browser and device you're using, your IP address, your location, the site you came from, the site you visit when you leave us, and how you used or didn't use our site or app. We may collect this using technology such as GPS and Wi-Fi. We also collect anonymous statistics about which Cards are most popular to help inform our recommendation engine, and to provide feedback to the Card collaborators.
How We Collect Information
We collect information directly from you.
- For example, if you create a Card, or become a Card member, or buy or sell a SongShare. We also collect information if you post comments or upload content on our websites or apps, or ask us a question.
- When you make a payment on the Platform, you may provide payment information such as your payment card or other payment details. We use Payment Card Industry compliant third-party payment services and we do not store your credit card information.
We collect information from you passively.
- We use tracking tools like browser cookies and web beacons.
- We also collect information from our apps.
- We may collect and process location information when you sign up for or use the Services.
We get information about you from third parties, for example, if you use a social media feature within our websites or apps or post to a social media platform, the social media site will give us some information about you.
The Services use log files. The information stored in those files includes IP addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks. This information is used to analyze trends, improve, protect and secure the Services, track member movement in the aggregate, and gather broad demographic information for aggregate use. IP addresses, may be linked to session IDs, member IDs, and device identifiers.
How We Use Your Information
OurSong uses the information we receive to operate the Services and to customize them for you. Subject to your privacy controls, your information, including your profile, username on the Platform, photos, members you follow and who follow you, the devices you use, and kudos and comments you give and receive will be shared on the Platform so that you may be able to participate in the Services, for example to show what Cards you are a contributor on, or what Cards you own. Certain information (e.g., your name and some profile information) may also be available to non-members on the web.
The basic personal data and additional personal data you provide and is collected by us will be used for the purpose of member identification.
We may also use the information we collect to market and promote the Services, activities on the Service, and other commercial products or services. This includes customizing your OurSong experience. For example, if we know that you like a particular genre of music, we may tell you about new Cards in that genre or show you sponsored content related to that genre. If we see that you live in a certain area, we may suggest a concert in that area.
OurSong may aggregate the information you and others make available in connection with the Services and post it publicly or share it with third parties, including creators whose Cards you have interacted with or from whom you have purchased Cards (as outlined in our Terms of Service). To do this, we remove certain account information, such as your name, and combine the resulting information with similar information from other OurSong members. Please visit your privacy controls if you object to OurSong using your information for these purposes. Because the data we aggregate comes from activities, information, and content you shared on the Services and which is identified with your OurSong user name among other information, someone looking at both this information you’ve shared and also the global heatmap, could draw a potential connection.
How can You manage or delete information about you?
OURSONG provides you with the ability to access, rectify, port and erase your data by sending your request via E-mail.
We store data until it is no longer necessary to provide our services, or until your account is deleted - whichever comes first. This is a case-by-case determination that depends on things like the nature of the data, why it is collected and processed, and relevant legal or operational retention needs.
How Information is Shared
In addition to sharing aggregated data about our members as described above, we also share information that identifies you in accordance with your preferences, as needed to run our business and provide the Services, and where required for legal purposes, as set forth below.
Service Providers
We may share your information with third parties who provide services to OurSong such as supporting and improving the Services, promoting the Services, processing payments, or fulfilling orders. These service providers will only have access to the information necessary to perform these limited functions on our behalf and are required to protect and secure your information. We may also engage service providers to collect information about your use of the Services overtime on our behalf so that we or they may promote the Service or display information that may be relevant to your interests on the Services or other websites or services.
Sharing Information and Activities
As a social network, we share your information with other OurSong members and the public in accordance with your privacy controls. For example, all or a portion of your name and other profile information is viewable by other OurSong members and the public and, subject to your privacy controls, additional information you provide may also be viewable.
If you link your OurSong account to other social networks and share your activities, they will be viewable on those third-party platforms. You should use caution when sharing information via third parties and you should carefully review the privacy practices of such third parties.
Publicly Available Information
Your information and content may be publicly accessible to and searchable by other OurSong members and non-members. We provide a variety of tools to control the sharing of your information.
Affiliates and Acquirors of our Business or Assets
We may share your information with affiliates under common control with us, who are required to comply with the terms of this Privacy Policy with regard to your information. If OurSong becomes involved in a business combination, securities offering, bankruptcy, reorganization, dissolution or other similar transaction, we may share or transfer your information in connection with that transaction.
Security
We implement a variety of security measures to help keep your information secure. The standard security measures we use will depend on the type of information collected. However, the Internet is not 100% secure. We cannot promise that your use of our sites will be completely safe. Accessing, Changing, or Deleting your Information
You may access or change your information from the Platform, including website, iOS or Android app. If you wish to delete your account, please follow the procedure below in the “Contacting Us” section.
We may preserve and share your information with third parties, including law enforcement, public or governmental agencies, or private litigants, within or outside your country of residence, if we determine that such disclosure is allowed by the law or reasonably necessary to comply with the law, including to respond to court orders, warrants, subpoenas, or other legal or regulatory process.
We may also retain, preserve or disclose your information if we determine that disclosure is reasonably necessary or appropriate to prevent any person from death or serious bodily injury, to address issues of national security or other issues of public importance, to prevent or detect violations of our Terms of Service or fraud or abuse of OurSong or its members, or to protect our operations or our property or other legal rights.
Third-party links and content
OurSong displays links and content from third-party feeds and sites, and downloads files directly from each third-party servers. These have their own independent privacy policies, and we have no responsibility or liability for their content or activities.
Children’s Online Privacy Protection Act Compliance
We never collect or maintain information at our website from those we actually know are under 13, and no part of our website is structured to attract anyone under 13.
International Transfers of Information
Information may be processed, stored, and used outside of the country in which you are located. Data privacy laws vary across jurisdictions, and different laws may be applicable to your data depending on where it is processed, stored, or used.
